Robert J. Gallagher

Gallagher (“Bob”) presently focuses his practice on tax controversy issues, representing taxpayers in disputes with the Internal Revenue Service and North Carolina Department of Revenue. However, previously, Mr. Gallagher has litigated a wide range of legal areas, including employment law, personal injury, commercial litigation, land use, will contests, and professional licensing representation.

Mr. Gallagher is a former Trial Attorney in the Attorney General’s Honors Program at the United States Department of Justice – Civil Tax Division. As part of the Tax Division, he represented the United States as both plaintiff and defendant in a variety of tax-related matters as well as in bankruptcy cases where the federal government was a creditor. He appeared in Federal District and U.S. Bankruptcy Courts throughout the eastern United States including North Carolina, Kentucky, Tennessee, the District of Columbia, Maryland, Pennsylvania, New Jersey, and Puerto Rico. Mr. Gallagher has experience litigating personal and business income tax issues, payroll tax assessments (including trust fund penalties assessed against individuals), penalty waivers, challenges to Captive Insurance Companies, FOIA requests, and other tax related matters.

Mr. Gallagher began his legal career as a Law Clerk to the Hon. Malcolm J. Howard, Senior United States District Judge for the Eastern District of North Carolina.

Mr. Gallagher’s family is a military family, and he is eager to help America’s men and women in uniform whenever possible. Mr. Gallagher is on the Executive Committee of Moore Young Professionals and devotes time to furthering the development of that group. When he is not at work Mr. Gallagher can frequently be seen running throughout the Sandhills area with his wife, Molly, and their vizsla, Celia.
